1. Acceptance of Terms

By downloading, installing, or using the Smart Calorie Tracker mobile application or accessing the smartcalorietracker.com website and calculators (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is owned and operated by Byte Craft Enterprises ("we," "our," or "us").

MEDICAL DISCLAIMER & NO WARRANTY Smart Calorie Tracker is an informational and educational tool designed solely to assist with macronutrient tracking and estimation. It is NOT a medical device. The information provided by the Service, including AI-generated calorie estimates, BMI calculations, and dietary suggestions, is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician, registered dietitian, or other qualified health provider with any questions you may have regarding a medical condition, diet, or fitness regimen. Never disregard professional medical advice or delay in seeking it because of information you read on the Service. We do not guarantee the absolute accuracy of the AI food scanning results, and you use the provided metrics entirely at your own risk.

2. Use of the Service

You agree to use the Service only for lawful purposes. You are strictly prohibited from:

  • Reverse-engineering, decompiling, or attempting to extract the source code or AI models from the Service.
  • Using the Service in any way that could disable, overburden, damage, or impair the site or app.
  • Attempting to gain unauthorized access to our systems or bypassing any payment or subscription mechanisms.
  • Using automated systems (bots, spiders) to scrape data from the Service.

3. Subscriptions and In-App Purchases

Certain features of the Service may be offered on a subscription basis or as premium in-app purchases.

  • Billing: Payments will be charged to your Apple ID or Google Play account at the confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Cancellations: You may manage or cancel your subscriptions by going to your App Store or Google Play Account Settings after purchase. We cannot cancel subscriptions on your behalf, as billing is managed entirely by Apple and Google.
  • Refunds: Except when required by law, paid subscription fees are non-refundable.

4. Privacy and Data Storage

Your privacy is important to us. Smart Calorie Tracker is designed as a "local-first" application. Your health metrics and dietary logs are stored locally on your physical device. We do not transmit, sell, or harvest your personal health data. By using the Service, you also agree to our Privacy Policy.

5. Intellectual Property Rights

All content, features, and functionality of the Service—including but not limited to the AI scanning algorithms, design, text, graphics, logos, and interfaces—are the exclusive property of Byte Craft Enterprises and are protected by international copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial use.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BYTE CRAFT ENTERPRISES, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service.
  • Any inaccuracies, errors, or omissions in the AI calorie scanning or macro calculations.
  • Any personal injury, health issue, or property damage resulting from your reliance on the Service.

In no event shall our total liability to you for all claims exceed the amount you paid us for the Service during the past six (6) months.

7. Indemnification

You agree to defend, indemnify, and hold harmless Byte Craft Enterprises and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service.

8. Changes to the Terms or Service

We reserve the right to modify or replace these Terms at any time. We also reserve the right to modify, suspend, or discontinue the Service (or any part thereof) without notice at any time. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Sri Lanka.
